1. Acceptance of these Terms
These Terms form a binding agreement between you (whether an individual or an entity operating a Business) and boina. If you are accepting these Terms on behalf of a Business, you confirm you have the authority to bind that Business. If you do not agree with any part of these Terms, you must not use the platform.
2. What boina is
boina provides software that lets Businesses manage their availability, staff, services, and appointments, and lets their clients ("End Customers") book those appointments online through a personalized booking link. boina is a scheduling tool: it does not provide beauty, wellness, or dental services itself, and it is not a party to any appointment booked through the platform.
3. Business accounts
To use boina, a Business must create an account and provide accurate information about itself, its staff ("collaborators"), and the services it offers. The Business is responsible for:
- Keeping its account credentials confidential and secure.
- The accuracy of the availability, pricing, and service information it publishes.
- All activity that takes place under its account, including actions taken by staff it grants access to.
- Complying with the licensing, health, and safety requirements applicable to its own industry and jurisdiction.
4. Personalized booking links
Every Business receives a personalized booking link (for example, booking.boinaapp.com/your-business) that it may share with its clients and on its own channels. This link is provided solely for the purpose of letting End Customers view real availability and book appointments with that specific Business.
You may not, and may not allow anyone else to:
- Use a booking link to impersonate another business or person, or to publish false, misleading, or illegal content.
- Use a booking link to collect End Customer data for purposes unrelated to scheduling, or to send unsolicited communications.
- Scrape, copy, or systematically extract data from any booking page, or reverse-engineer the booking flow.
- Share, resell, or sublicense access to a booking link, an account, or the underlying platform to a third party without boina's written consent.
- Use the link to book fake or abusive appointments intended to disrupt another Business's calendar.
boina may suspend or disable a booking link that it reasonably believes is being used in violation of these Terms.
5. Appointments with your clients
Any appointment booked through boina is an agreement made directly between the Business and its End Customer. boina facilitates the scheduling, confirmation, and reminder process, but is not responsible for:
- The quality, safety, timeliness, or outcome of any service rendered by a Business.
- No-shows, late cancellations, disputes, or refunds between a Business and its End Customers.
- Pricing, promotions, or policies that a Business communicates to its clients outside the platform.
Businesses are solely responsible for defining and honoring their own cancellation, rescheduling, and refund policies with their End Customers.
6. Plans and billing
boina offers different subscription plans with varying limits and features (such as the number of collaborators, notification channels, and reporting tools). Plan details, pricing, and billing cycles are confirmed at the time a Business subscribes and may be updated from time to time, with reasonable notice for any change that affects an active subscription.
7. Acceptable use
You agree not to use boina to violate any applicable law, infringe on third-party rights, transmit malicious code, interfere with the platform's operation or security, or attempt to gain unauthorized access to other Businesses' accounts or data.
8. Intellectual property
boina and its underlying software, design, and branding are the property of boina and its licensors. Businesses retain ownership of the content they upload (such as service descriptions, images, and business information) and grant boina a limited license to host and display that content solely to operate the platform and their booking page.
9. Suspension and termination
A Business may cancel its subscription at any time through its account settings. boina may suspend or terminate access to an account that breaches these Terms, poses a security risk, or is used unlawfully, with notice where reasonably possible.
10. Disclaimers and limitation of liability
boina is provided "as is" and "as available." To the maximum extent permitted by law, boina disclaims all warranties of merchantability, fitness for a particular purpose, and non-infringement, and is not liable for indirect, incidental, or consequential damages, including any dispute, loss, or harm arising from an appointment or interaction between a Business and its End Customers.
11. Changes to these Terms
boina may update these Terms from time to time. Material changes will be communicated to Business administrators, and continued use of the platform after a change takes effect constitutes acceptance of the updated Terms.
12. Governing law
These Terms are governed by the laws applicable in the jurisdiction where boina is legally established, without regard to conflict-of-law principles, unless a separate written agreement between boina and a Business states otherwise.
